Privacy Policy

While signing up for the QAPP Application, it’s mandatory to carefully read the Terms and Conditions as well as Privacy Policy. We are entitled to periodically amend Privacy Policy.

This Privacy Policy is an essential part of Our Terms and Conditions, which are binding for both parties.

Terms in the Privacy Policy shall be defined in accordance with the terms provided in the Terms and Conditions.

 

This Privacy Policy will provide you with information on the scope, purpose and basis of processing your personal data. This Privacy Policy also informs you of other important information related to the protection of personal data.

For the purposes of this Privacy Policy, QAPP will be referred to as “We” and/or “Company”, and the Customer will be referred to as “Customer” and/or “You”, and our mobile application and website will be referred to together as “Application”.

 

  1. Basis for Processing Your Personal Data 

Your consent to the Privacy Policy and Terms and Conditions, by which You grant Us authority to process your personal data, serves as the legal basis for processing your personal data.

In order to offer you services, we must process Your personal data.

Your personal data may also be processed if it is necessary to comply with Georgian legislation.

 

  1. How We Obtain Your Personal Data

Your personal data is collected based on your own free will as a result of the information you provide when registering for the Application.

In order to use Our services, You are required to provide mandatory information within the Application. Failing to do so will result in your inability to access Our services.

We process your data to the extent provided by You while using Our services, and We may obtain information related to You from other available sources as well, in compliance with the legislation of Georgia.

 

  1. What Types of Personal Data Do We Collect?

 

We collect the following information you provide during the registration process: Name;

  • Surname;
  • Mobile number;
  • Bank details [including bank card numbers and account numbers];
  • E-mail address;
  • Vehicle information (vehicle brand, vehicle model, vehicle type, vehicle state number)
  • Other additional voluntary information.

 

We will also collect information when you use our services (through the application and/or website), namely:

  • information about your activity and behavior;
  • information about your devices that you use to access our website (for example: device type, IP address, etc.);
  • Information about your geolocation (for detailed information, see the subsection “Use of location data”)
  • communication with you;
  • history of financial transactions carried out on our Application or website;
  • any other information that you provide us for legitimate purposes, or that becomes available to us through our relationship with you.

 

We will collect your personal data from other sources, specifically:

  • from publicly available sources;
  • Organizations in contractual or partnership relationships with us, in compliance with Georgian legislation.

The above list is not exhaustive and We may collect other data, in compliance with Georgian legislation.

 

  1. The following are the purposes for which your personal data will be used:
  • to communicate with You and provide our services;
  • to deliver informational messages important to You;
  • to successfully carry out operations and transactions related to Your account;
  • to properly fulfill legal obligations;
  • to safeguard legal interests;
  • to notify You about updates in the Application;
  • to develop the business according to your requirements;
  • to determine how You use Our services.
  • to prevent criminal activities;
  • For other legitimate purposes provided by the Law of Georgia on Personal Data Protection.


  • Direct Marketing

By registering on the Application or website and in certain cases, by popup notification you give consent to us for processing your data for the purposes of direct marketing and agree to receive notifications about promotions, news, our services and exclusive offers for you.

 

You will receive notifications on your mobile phone number (both through phone calls and SMS messages), and your email address. 

 

Direct marketing communications will be sent to you directly by us or on our behalf through authorized persons.

 

In order to direct marketing (to send you individual offers), the following information provided by you is processed: name, surname, email address, mobile phone number, history of your financial transactions and vehicle information.

 

 For the purposes of direct marketing, your data is processed until you withdraw your consent.

If you no longer wish to receive marketing communications, please contact us using one of the following means:

  • Email: [email protected];
  • Sending the NOSMS code attached to the marketing SMS you received.


Please note that even after you withdraw your consent, you will still receive informational messages related to your account that are necessary for us to provide you with services.


  • Use of Location Data

By using QAPP, You consent to the collection and use of Your device’s location data. This data is crucial for certain features of the Application and is used solely for the following purposes:

 

Proximity Features: When You are near a Car Wash box as identified by Our system, the Application will display a button labeled “I am here”. This feature is designed to enhance Your user experience by allowing quick access when You are in close proximity to one of Our Car Wash boxes.

 

Search and Filter Features: If You opt to filter for Car Wash boxes within the Application, We use Your location data to display the nearest available Car Wash box to Your current location. This ensures that search results are tailored to Your convenience, helping you find the closest available service.

Your location data is never used for any other purpose outside of the aforementioned functionalities, nor is it shared with Third Parties without Your explicit consent. 

 

It’s important to understand that You can turn off location services for QAPP at any time through your device settings, but doing so may affect the functionality of our services and user experience of the Application.

By continuing to use QAPP, you acknowledge and accept Our use of location data as described above. If you do not agree with these terms, please refrain from using the Application or turn off location services for QAPP.

 

  1. Data Sharing

Please note that your personal data may be shared with third parties for various reasons. This may include sharing your data with third-party partners for direct marketing purposes, or with service providers to fulfill our contractual obligations to you. Your data may also be shared if it is necessary to fulfill your interests or our contractual obligations, or if it is required by law. Some of the third parties with whom your information may be shared include:

  • Partners with whom we have a contractual relationship
  • Service providers who help us fulfill our obligations under the law or provide better security for our Application or website
  • Payment service providers and financial institutions to prevent fraud and financial crime;
  • Companies that provide user experience analysis to improve our Application/website;
  • Investigative, regulatory or other government/administrative authorities as required by law
  • Legal successors of our company or third parties to whom we transfer our business or part of our business
  • We may also share your data with external auditors if necessary. 

We may share your information with other third parties as permitted by law and as stated in this policy. 

 

  1. Your Rights 

The matter of personal data protection is regulated by the Law of Georgia on Personal Data Protection.

Based on the Law of Georgia on Personal Data Protection, You, as a data subject, have the right to request from Us, information on data processing, namely:

  • What types of your personal data are processed;
  • Purpose and basis of data processing;
  • information about the source of data collection/retrieval;
  • Information about the data storage period (time);
  • Information on international data transfer.
  • Information about the identity of the data recipient or the categories of data recipients, including information about the basis and purpose of the data transfer, if the data is transferred to a third party;

You have the right to receive copies of this data without any charge, unless the law specifies a fee for such delivery or We establish a fee in accordance with the law.

You will receive the information you requested within 10 working days after the request. Depending on the large volume of information or other objective circumstances, this period may be extended by no more than 10 working days, which you will be notified about.


  • The right to correct, update and complete data

You have the right to request the correction, update and/or completion of false, inaccurate or incomplete data about you.


  • The right to stop processing, delete or destroy data

You have the right to request the termination, deletion or destruction of data about you. This right is not absolute (unlimited). We are entitled to refuse to comply with this request if the data is processed in compliance with the law, and as a result of the study of the specific circumstances, it is determined that the request is unreasonable or there is another basis defined by law, which gives us the right not to satisfy your request.

 

  • Right to block data

You have the right to request data blocking if you dispute the authenticity or accuracy of the data; Data processing is illegal, however you do not want the data to be deleted and request data blocking; The data is no longer necessary to achieve the purpose of its processing, although you need it to file a complaint/lawsuit; You have requested the termination, deletion or destruction of data processing and this request is being processed; There is a need to preserve data for use as evidence. If required by law, we reserve the right to refuse to comply with data blocking requests.

 

  • Right to data portability

In case of automatic data processing on the grounds established by the Law of Georgia on Personal Data Protection, if it is technically possible, you have the right to receive data in a structured, publicly usable and machine-readable format or to request the transfer of this data to other person responsible for processing.

 

  • Automated Data Processing (Profiling)

You have the right not to be subject to a decision made solely by automated means, including profiling, that produces a legal or other material consequence for you, unless the profiling decision: is based on your express consent; is necessary to enter into or perform a contract between us; is provided by law or by a subordinate normative act issued within the scope of delegated authority based on the law.

  • The right to withdraw consent

You have the right to withdraw your consent at any time. However, keep in mind that if you withdraw your consent to the processing of personal data, we will no longer be able to provide you with our services.

 

  • The right to file a complaint

In case of violation of the above rights, as well as your rights provided by the law of Georgia on Personal Data Protection and established rules, you can apply to the Personal Data Protection Service.

  1. A minor

Minors under the age of 18 are prohibited from using Our Application. We do not store and/or gather information from individuals under the age of 18. Protecting the personal data of minors is very important to Us. Therefore, if We find out that Our customer is an individual under the age of 18, We will take appropriate measures to delete such a customer’s personal information from the company’s database.

 

  1. Changes and Additions

This document can be modified and supplemented. If such modifications or additions occur, the details will be made available on the Application and website.

These changes and modifications become effective as soon as they are published in the Application.

As long as the modifications and changes are published, your authorization to use the Application will be interpreted as consent to the modified agreement.

 

The present Privacy Policy may be drawn up in several languages, and in case of contradiction and/or any inconsistency between them, the text drawn up in the Georgian language shall prevail.
