Terms & Conditions

These Terms and Conditions govern the legal relationship between You and QAPP and constitute a binding agreement between the parties.

QAPP is a mobile application through which You can remotely book the desired time to wash Your car at the desired car wash.

For the purposes of the regulation of Terms and Conditions, QAPP will be referred to as “We ” and/or “Company” and the Customer will be referred to as “Customer ” and/or “You.”

You will always have the opportunity to review Our Terms and Conditions through the Application.

We may amend Terms and Conditions from time to time. Amendments will be effective upon publication of updated terms. Your continued access to Our Application and/or use of the Services constitutes Your acceptance of the modified Terms.

This Terms and Conditions with the Privacy Policy regulate the relationship between QAPP and the Customer.

With your consent to this Terms and Conditions you also agree to Our Privacy Policy.

 

1.Definition of Terms

 

QAPP and/or Application – refers to this application.

Service – shall mean the service provided by Us, through which You can schedule car wash appointments remotely at Your preferred time and preferred Car Wash.

Personal Account (Profile) –  shall mean a personal account registered in the Application.

Car Wash – refers to car washing service provider, representing either a natural or legal person, engaged in a contractual relationship with Us.

Third Party –refers to any natural and/or legal entity.

Car Wash Service Fee – refers to the fee for Car Wash services established by the Car Wash facility and paid by the Customers for washing service.

Fees – refers to the Fees paid to Us for the reservations that You have made through Our Application.

Service Fee – shall mean Car Wash Service Fee and Our Fee combined.

 

 

2. Customer’s Personal Account

 

In order to receive Our Service, You must create Your Personal Account and indicate all required information that is requested by Us.

In order to use the QAPP Application, You need to register and indicate the following data:

  • mobile number;
  • name;
  • last name;

The mobile number is verified through a one-time code that will be sent to Your mobile number as a short text message.

After creating a Personal Account, You will be able to use Our Service and manage Your Personal Profile.

You are fully responsible for the accuracy of the information You provide at any stage of receiving the Service.

We reserve the right to request further information and/or documentation from You at any time, including identification documents.

Failure to provide information will result in Service suspension and/or termination.

 

3.Procedure for reservation

In order to receive the Service, You should follow the steps required in Your Personal Account and provide all the requested information.

 

  • Vehicle information

To make a reservation, You need to add the following car information to Your Personal Account:

  • Vehicle brand;
  • Vehicle model;
  • Vehicle state number.

You can add a maximum of 3 (three) vehicles to Your Personal Profile.

 

You must also specify:

  • The location, namely the area where You want to use the Car Wash service.
  • Preferred Car Wash;
  • Reservation date and time;
  • The service You want to receive (for example, a full wash, an exterior wash, or a salon wash)
  • Exact time from available times.

After providing all the required information, press the “Confirm” button, and You will proceed to the payment stage.

At the payment stage, You have the opportunity to verify all the details of Your reservation and Service Fees.

After successful completion of the reservation, You can check how much time You have left until the reservation time through the Application.

Please note that You should arrive at the Car Wash 10 (ten) minutes earlier.

 

4.Change of Reservation

You have the one-time opportunity to change the time of the reservation at any time before the reservation time.

Please note that only the reservation time is subject to change, and the Car Wash and specified service cannot be changed.

It is not possible to change the reservation time once You have already changed it.

 

5.Car wash services

In order to receive the car wash service, upon arrival at the place during the reservation, You must press the “I’m here” button in the Application. “I’m here” button will be activated before 10 [ten] minutes of the reservation time. If You do not press the button before the reservation time, Your arrival will be considered as a late. However, please note that if You click the “I’m here” button but You are not actually there, the terms of the late check-in will apply.

After the service is started by the Car Wash, a window displaying the relevant information will appear in Your Personal Account, which will also provide You with the estimated time of completion of the wash.

The wash completion time shown in Your Personal Account is an estimate and does not necessarily represent an accurate or reliable time.

We are not responsible in case of increase and/or decrease in washing time.

We are not responsible if the service is delayed by the Car Wash.

After the wash is completed, You must follow the information on Your account and show up at the vehicle.

You understand and consent that Our service is provided through Car Washes that are independent contractors.

We are not responsible for the quality of the washing carried out by Car Washes.

If You do not show up at the Car Wash at the reservation time, You will not be refunded the Service Fee You have paid.

If You arrive later than Your reservation time, the Car Wash has the right to decline the Service. In such a case, You will not be refunded the Service Fee You have paid.

If for any reason the Car Wash is unable to provide service at the reservation time, all claims arising from Your side must be directed to the Car Wash and this shall not constitute Our responsibility. In addition, We will play the role of a mediator and assist You in resolving the issue.

If the Car Wash, is unable to provide You with the services specified in Your reservation for any reason, please email Us. After registering the claim, We will investigate the issue within 10 (ten) working days. If the Car Wash is found to be at fault, the payment for the Car Wash Service Fee will be refunded to Your bank account. Please note that Our Fees are non-refundable.

 

6.Payments

Payment is made only by cashless payment through the bank card saved in Your Personal Account.

Payments are final and non-refundable, except as specified in these Terms and Conditions.

The recipient of the paid amount is the QAPP, which then transfers the Car Wash Service Fee to the Car Wash.

To complete the payment step, You need to add a bank card to the payment channel of JSC “TBS Bank” or JSC “Bank of Georgia”. After choosing the payment channel, You will be redirected to the page of the selected bank, where You must enter Your card details in order to remember the card in the Application and make a successful payment.

The payment request is processed and confirmed by the bank.

By adding a bank card to Your Personal Account, You agree to add the card and use recurring payments.

You can add a new card or delete a card You have already added at any time.

We do not have access to both the payment page and the bank card data provided by the Customer.

In the event of successful completion of the payment, a message containing relevant information is displayed in the Application.

 

7.Representations and Warranties

By agreeing to these Terms and Conditions, You confirm that You have the legal capacity and full authority under the laws of Georgia to consent and perform the actions provided in these Terms and Conditions.

By agreeing to these Terms and Conditions, You confirm that You are a natural person who has reached the age of 18, who has the authority under the law of Georgia to enter into relationship under these Terms and Conditions.

You confirm that, based on Your own free will, You agree that all and any provisions of these Terms and Conditions are binding for the parties.

By agreeing to these Terms and Conditions, You warrant that all and any information [including personal data] provided by You belongs to You.

By agreeing to these Terms and Conditions, You confirm that You will use the Application in good faith and comply with the requirements stipulated by the Georgian legislation and these Terms and Conditions.

You agree that Your personal data may be used by Us for direct marketing purposes.

You agree that all and any copyrighted material in the Application is Our intellectual property and shall not be used without Our written consent.

You warrant that You will not reproduce, copy or otherwise use any of Our intellectual property, including but not limited to Our name, trademarks, logos and/or Our other intellectual property.

By accepting these Terms and Conditions, You agree that We are not responsible for any and all legal consequences arising from the relationship between the Car Wash and You.

You confirm that if Your username and other information of Your Personal Profile becomes available to any Third Party, You will immediately notify Us through the means of communication provided in these Terms and Conditions.

By agreeing to these Terms and Conditions, You confirm that You will carefully read these Terms and Conditions at the moment of each authorization, therefore, each authorization carried out by You implies that You agree to the published Terms and Conditions.

You agree that We are entitled to cancel and/or block Your Personal Account in the cases provided by law, instructions carried out by the law enforcement authorities and/or by the court in accordance with the Georgian Law.

 

8.Managing the Personal Profile

In Your Personal Profile You can see information about Your account, including the reservations You have made, cars, and bank cards you have added to Your Account.

You can also view information about the financial transactions.

In Your Personal Profile You can add and/or delete desired vehicles.

In Your Personal Profile, You can delete saved bank cards and/or add a new card.

 

9.Personal Data Processing

By agreeing to these Terms and Conditions, You consent to the Company’s Privacy Policy, that stipulates the basis for processing Your personal data.

Your personal data will be processed in accordance with the legislation of Georgia.

 

10.Limitation of Liability

We are not responsible for any damages resulting from the actions of any Third Party.

YOU ACKNOWLEDGE THAT THE CAR WASH IS OUR INDEPENDENT CONTRACTOR, THEREFORE WE ARE NOT RESPONSIBLE FOR ANY CLAIMS AND/OR DAMAGES ARISING FROM THE RELATIONSHIP BETWEEN YOU AND THE CAR WASH, INCLUDING BUT NOT LIMITED TO THE QUALITY OF THE VEHICLE WASH, DAMAGE TO THE VEHICLE DURING THE WASH, LOSS OF ITEMS, AND FOR THE CLAIMS AND/OR DAMAGES ARISING ON ANY OTHER BASIS.

We declare that, to the best of Our ability, We ensure the collection, storage and processing of personal information provided by You in accordance with the requirements of Georgian legislation. We do not accept responsibility for any damage caused by the use of Your personal data by any Third Party in a criminal manner or/and in cases of unauthorized access.

We are not responsible for any and all damages if the username and other information of Your Personal Account becomes available to any third party due to a reason beyond Our action or control.

We are not responsible for any temporary interruptions in the operation of the Application. However, We assure You that We will take all necessary measures to minimize such interruptions and promptly address any errors that may occur. Our goal is to resolve any issues as quickly as possible.

 

11.Term of the Agreement

These Terms and Conditions are effective from the moment You agree to them and remain in effect until You delete Your Profile.

We reserve the unilateral right to cancel and/or suspend Your use of the Application if We believe You have violated these Terms and Conditions, or if the information You provided at the time of registration is found to be inaccurate. In this case, any restriction and/or termination of your right to use the Application will be communicated to you through your designated communication channels.

These Terms and Conditions may be terminated at any time, at Your initiative, by deleting Your Personal Profile.

  1. Use of Location Data

By using QAPP, You consent to the collection and use of Your device’s location data. This data is crucial for certain features of the Application and is used solely for the following purposes:

Proximity Features: When You are near a Car Wash box as identified by Our system, the Application will display a button labeled “I am here”. This feature is designed to enhance Your user experience by allowing quick access when You are in close proximity to one of Our Car Wash boxes.

Search and Filter Features: If You opt to filter for Car Wash boxes within the Application, We use Your location data to display the nearest available Car Wash box to Your current location. This ensures that search results are tailored to Your convenience, helping you find the closest available service.

 

Your location data is never used for any other purpose outside of the aforementioned functionalities, nor is it shared with Third Parties without Your explicit consent. It’s important to understand that You can turn off location services for QAPP at any time through your device settings, but doing so may affect the functionality and user experience of the Application.

By continuing to use QAPP, you acknowledge and accept Our use of location data as described above. If you do not agree with these terms, please refrain from using the Application or turn off location services for QAPP.

 

  1. Safety and Incident Reporting Procedures

You are obliged to follow security measures and make all possible efforts to prevent unauthorized access to Your Personal Account by Third Parties.

You are obliged to follow precautionary measures in the event that You authorize through a third-party’s technical devices and log out of Your Personal Account after using the Application.

In the event of fraud and/or suspicious activity on Your Personal Account and/or if You suspect that Your account is being used illegally, contact Us immediately on the hotline: —-

 

  1. Governing Law and Dispute Resolution Procedure

These Terms and Conditions have been compiled in accordance with the requirements of the Georgian legislation and represent the standard terms of the contract stipulated by the Civil Code of Georgia. All and any type of relationship provided by these Terms and Conditions shall be governed by the laws of Georgia.

Any dispute arising between QAPP and the Customer shall be resolved through negotiation. In the event of unsuccessful negotiations, the case will be considered by the system of general courts of Georgia according to the legislation of Georgia.

 

  1. Changes and additions

We reserve the right at any time to unilaterally amend these Terms and Conditions by publishing changes to the Application. Once the changes are published, Your authorization to the Application will be deemed to be Your full understanding of the cchanges,and You agree that the relationship between us will continue under the modified terms and conditions.

If You do not agree with the changes made by Us to the Terms and Conditions, You shall cancel Your Personal Profile within 1 [one] day, otherwise it will be considered that You fully agree with the modified Terms and Conditions.

 

  1. Communication

In case of any and all questions arising as a result of the relationship stipulated by these Terms and Conditions, You should contact Us in writing at the following e- mail address:

 

  1. Transitional provisions

These Terms and Conditions represent the standard terms of the contract provided for by the Civil Code of Georgia.

Matters not regulated by these Terms and Conditions shall be governed by the laws of Georgia.

Failure to comply with these Terms and Conditions will result in legal consequences provided by Georgian legislation, and each party will be held responsible for non-compliance with the Terms and Conditions.

The headings in these Terms and Conditions are only for reference and do not affect the definitions of terms.

The invalidity of any clause of these Terms and Conditions shall not invalidate the entire Terms and Conditions.

If You want to present any kind of claim or complaint arising from the use of the Service, You shall  submit the claim or complaint in writing to the following email address:—–. However, You should note that the claim/complaint submitted by You must contain the following information, namely:

  • Name, surname, personal number of the author of the claim/complaint;
  • Mobile number and address of the author of the claim/complaint;
  • The essence of the claim/complaint;
  • The request made by You in the claim/complaint must be identifiable;
  • Signature of the author of the claim/complaint, date of signature.

PLEASE, NOTE that, In the event that Your claim/complaint does not satisfy all or any of the requirements set forth in these Terms and Conditions, Your claim/complaint will remain unresolved.
